2. Scope

This privacy policy applies to the lapdata.de website, the Pitwatch iOS app and the associated Pitwatch device and firmware API. It explains which personal and technical data is processed in each area.

3. Hosting and technical access data

The website, publicly available firmware files and the device and firmware API are provided through STRATO. When you access the website, download firmware or send a request to the API, technically necessary server log files may be processed by the hosting provider. This may include in particular your IP address, the date and time of access, requested files or URLs, HTTP status, browser type, operating system and referrer URL.

This processing is carried out for the provision, stability and security of the website, downloads and API. Further information on data processing by STRATO can be found in the provider's privacy information.

4. Data processed locally in the Pitwatch app

Driver names, sessions, lap times, settings and CSV data generated from them are generally processed and stored locally on the iPhone. They are not transmitted to LapData automatically.

Session or CSV data is exported only when you explicitly start an export through the iOS share function. In that case, you decide which service or person receives the data.

5. Technical device data and device/firmware API

When a Pitwatch device uses the device and firmware API, technical information required for device operation and firmware updates is processed. This includes in particular:

  • the technical Pitwatch device ID,
  • product, hardware revision and batch,
  • firmware, bootloader, protocol and app versions,
  • the active firmware slot and boot confirmation status,
  • firmware checks, available update versions, update results, and technical error and status information,
  • the times of technical requests and the usual HTTP and server log data generated in the process.

The device ID is used as a technical identifier for device management. Under the current implementation, it is not linked to an app user account. However, it may permit identification when combined with other technical data or an IP address and is therefore not treated as anonymous in all cases.

6. Purposes and legal bases

We process technical device data in particular for the following purposes:

  • device authentication and secure API communication,
  • checking device and firmware compatibility,
  • providing and carrying out firmware updates,
  • documenting update results,
  • operational security, diagnostics and support, and
  • protection against misuse.

Where processing is necessary for use of the app and device functionality or for steps prior to entering into or performing a contract, the legal basis is Art. 6(1)(b) GDPR. Where processing is necessary for secure, reliable and protected operation, it is based on Art. 6(1)(f) GDPR. Our legitimate interest is the secure provision and further development of the technical functions, as well as diagnostics and misuse prevention.

7. Contact form and email contact

If you contact us using the contact form or by email, we process the information you provide in order to handle your enquiry. This includes in particular your name, email address, subject, company/team details and the content of your message.

The processing takes place solely for the purpose of handling and replying to your enquiry. Providing additional information is voluntary unless it is marked as a required field.

The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to steps prior to entering into or performing a contract. In other cases, we process the information on the basis of Art. 6(1)(f) GDPR; our legitimate interest is handling and replying to your enquiry.

8. Features not used

This website and, under the current implementation, the Pitwatch app do not use analytics, tracking or advertising tools or corresponding SDKs. There are no user accounts, no advertising and no profiling for advertising purposes. No external cookies are set on the website for analytics or advertising purposes.

The Pitwatch app does not automatically transmit location data, contacts, photos, driver names, sessions or lap times to LapData.

9. Local font hosting

Font files used on this website are hosted locally on the web server. Therefore, no data is transmitted to external font providers when the website is accessed.

10. Recipients, storage and erasure

As the hosting provider, STRATO processes technical access data in connection with providing the website, API, firmware files and associated database infrastructure. Data is not shared with third parties for advertising or tracking purposes. Any further disclosure takes place only where required by law or necessary to handle your enquiry.

Data from contact enquiries is stored only as long as necessary to process the enquiry and to comply with statutory retention obligations.

We retain technical device data and technical log data only for as long as necessary for device operation, firmware delivery, security, support or legal obligations. Afterwards, the data is deleted or anonymised unless a retention obligation prevents this. You can contact us atlegal [at] lapdata [dot] deto request access, rectification or erasure. Erasing a device association may impair or prevent authentication and firmware updates for the affected Pitwatch device.

11. Your rights

Within the framework of the applicable law, you have the right to access, rectification, erasure, restriction of processing, data portability and to object to the processing of your personal data.

You also have the right to lodge a complaint with a competent data protection supervisory authority.
